Terms of Use

These Terms of Use ("Terms") govern your access to and use of MachineSetu, a digital platform accessible at machinesetu.com (the "Platform"), operated by the individual(s) or entity currently doing business as MachineSetu, based in Kolhapur, Maharashtra, India ("we", "us", "MachineSetu"). By creating an account, browsing listings, or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1. What MachineSetu Is

MachineSetu is a marketplace that helps buyers, sellers, and renters of pre-owned and refurbished industrial machines, equipment, accessories, and tools find and connect with one another directly, without charging any commission on either side.

MachineSetu is not a party to any transaction that takes place between users. We do not buy, sell, own, inspect, certify, or take possession of any machine or equipment listed on the Platform. We do not collect, hold, or process payment for any transaction — all negotiation, inspection, payment, delivery, and after-sale matters happen directly between the buyer and seller (or renter and owner), entirely outside the Platform.

We provide the space for connection. We do not guarantee the accuracy of any listing, the condition, safety, legality, or working status of any machine, the identity or trustworthiness of any user, or the successful completion of any deal.

2. Who Can Use MachineSetu

You must be at least 18 years old and capable of entering into a legally binding contract under Indian law to use the Platform. By registering, you confirm that the information you provide (name, phone number, email address, and any business details) is accurate and that you will keep it up to date.

3. Your Account

Account access is secured through a one-time verification code sent to your registered email address. You are responsible for keeping this access secure and for all activity that happens under your account. Tell us immediately if you believe your account has been accessed without your permission.

4. Listings

If you list a machine for sale or rent, you are solely responsible for the accuracy of everything in that listing — description, specifications, condition, photos, asking price, and your own contact details. You confirm that you have the legal right to sell or rent the machine described, and that the listing does not violate any law or infringe anyone else's rights.

We may review, edit, suspend, or remove any listing at our discretion, including in response to a user report, without prior notice, if we reasonably believe it violates these Terms or applicable law.

5. What You Agree Not to Do

You agree not to:

• Post a listing for a machine you do not own or have the right to sell/rent, or that is stolen, counterfeit, or illegal to sell in India
• Misrepresent the condition, specifications, ownership, or working status of a listed machine
• Impersonate another person or misrepresent your affiliation with any business
• Use the Platform to harass, defraud, or mislead another user
• Scrape, copy, or systematically extract listing data from the Platform
• Upload content that infringes someone else's intellectual property, or that is unlawful, defamatory, or obscene
• Attempt to interfere with the security or normal operation of the Platform

6. No Payment Handling, No Warranty on Deals

Because MachineSetu never collects or holds payment, and never inspects any machine, we cannot and do not guarantee any transaction. We strongly encourage buyers to physically inspect a machine and verify a seller's identity and ownership before making any payment, and to use safe, traceable payment methods when transacting directly with another user.

7. Grievance Redressal

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer to receive and act on complaints about content or conduct on the Platform.

8. Intellectual Property

The MachineSetu name, logo, and the design and code of the Platform belong to us. Content you upload (listing photos, descriptions, videos) remains yours, but by posting it you give us a non-exclusive license to display it on the Platform for the purpose of operating the marketplace.

9. Limitation of Liability

To the fullest extent permitted by law, MachineSetu is not liable for any loss, damage, or dispute arising from a transaction between users, the condition or performance of any machine, or the conduct of any user. The Platform is provided "as is," without warranty of any kind.

10. Suspension and Termination

We may suspend or terminate your account if we reasonably believe you have violated these Terms, posted fraudulent or misleading content, or engaged in conduct that harms other users or the Platform.

11. Governing Law

These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts in Kolhapur, Maharashtra.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above. Continued use of the Platform after a change means you accept the updated Terms.
